What Is a Residency Affidavit?
A residency affidavit is a formal sworn statement, made under penalty of perjury, in which the affiant declares that a named individual lives at a specified address. Unlike a simple proof of residency letter, an affidavit is intended to carry legal weight and is often signed before a notary public. It is used when standard address documents are insufficient or when a higher level of verification is required. Official state affidavit forms usually require the resident and the person certifying the address to identify themselves clearly and connect the applicant to the residence.
When Do You Need a Residency Affidavit?
Residency affidavits are commonly required for school enrollment when a child lives with someone other than a parent, for immigration proceedings that demand sworn proof of a U.S. address, for court filings where residency is a jurisdictional factor, and for government benefit applications. They are also used during estate proceedings, voter registration challenges, and tax residency disputes. Many of those affidavit workflows also require supporting proof from the certifier, notarization, or an in-person signature before the DMV accepts the form.
